Texas Roadhouse Inc. (NASDAQ:TXRH) Legal Tussle Over Age Discrimination

Boston, MA 10/01/2014 (wallstreetpr) – Texas Roadhouse Inc. (NASDAQ:TXRH), which is known for its fresh baked bread and a lively dining atmosphere and synonymous with line dancing as well as loud country music has filed a lawsuit in a Kentucky District Court. The company is seeking an order that would compel Equal Employment Opportunity Commission (EEOC) to produce agency records as required under the freedom of information act. The request had been tabled in July and August of this year.

Accusations against Texas Roadhouse

The request of the documents comes in the wake of Texas Roadhouse Inc. (NASDAQ:TXRH) being accused of discriminating employees above the ages of 40, on positions that involve constant interactions with consumers such as bartenders and hosts. Texas Roadhouse has vehemently opposed this accusations maintaining that front-of-house positions mostly require energetic employees who may be required to participate in dancing from time to time.

The EEOC had launched a national wide campaign in 2011 alleging that Texas Roadhouse Inc. (NASDAQ:TXRH) was engaging in age discrimination through its employment system.

EEOC Failures

Texas Roadhouse claims it has not received any response from the EEOC. By law, once an order is issued’ by the federal FOIA, agencies are required to respond within 20-30 business days. Something the EEOC failed to do. The EEOC is’ accused of failing to provide written explanations of why it failed to comply with the initial order. Texas Roadhouses alleges that EEOC failed to provide relevant documents relating to the total amount of taxpayer funds that were expended in a case against it in 2011.

EEOC is’ also accused of failing to provide all the evidence related to an investigation and charges that had alleged Texas Roadhouse Inc.(NASDAQ:TXRH) engaged in age discrimination in terms of ‘front-of-the-house’ saga. The EEOC has also failed to produce all the statements that it gave to the media regarding the case.
