J.C. Penney Company, Inc. (NYSE:JCP) – In Mid Of Legal Issues

Boston, MA 10/16/2013 (wallstreetpr) – J.C. Penney Company, Inc. (NYSE:JCP), is a retailer company operating with 1,102 departments stores spread across 49 states, and its main business is to sell merchandise and services to customers through its retail department.

The company is currently facing some problems in its stock, as well as the legal problem of the Pomerantz law firm filing a class action against the company and some of the officers of the company. The entire case was about making misleading and false statements, and also failing to disclose the material facts of the company.

Along with the other difficulties, the company was sued by its own shareholders for the surprise decision made by the company to issue more than $810million of stock to shore up liquidity. Because of this, there was a steep fall in the share price of the company, in addition to Perry crop reducing its stake in the company by 50% to 3.28%, down from 8.62%.

At the same time, the company decided to go public with its offerings. The stock will be listed on the New York stock exchange. The company is offering $84 million, for which the price of each share will be $9.65. The amount will be used for the general corporate purposes, as well as to build up its cash reserves.

The company is trying to bring in a bunch of experience by appointing Saks Sadove as the new CEO of the company. He will be joining the company as soon as he leaves his current job, though the company is trying to convince him to join in early with the company.

The government shutdown has already affected the company, as it becomes difficult for JCP to service its loan given the declining revenue. The total loan amounted to $34.4 billion.
