ITC Favoured ResMed Inc. (NYSE:RMD) In Patent Infringement Action

Boston, MA 08/25/2014 (wallstreetpr) – ResMed Inc. (NYSE:RMD) recently in the case involving BMC products, won the initial decision given by International Trade Commission (ITC)’s administrative law judge. In the case which involved infringing patents, ResMed had filed a lawsuit against China-based BMC Medical Co., Ltd. RMD had accused that in every nine BMC products named in action, there has been infringement of one or more patented copyrights of ResMed.

The Decision

The ITC Judge Thomas Pender, in his decision, said that ITC has banned BMC as well as 3B Medical, its U.S. distributor from now just importing, but also selling any BMC product which involves infringement in The States.

A cease and desist order was also recommended by the Judge, in which he suggested that BMC as well as 3B shall be enjoined from testing, marketing, storing, advertising or selling of any infringing product in this country.

ResMed Inc. (NYSE:RMD) has been manufacturing and designing the devices for sleep-disorder breathing treatment.

Infringed Products                                     

The Judge unveiled that among re-invented and original versions of below mentioned BMC masks as well as BMC’s InH2 humidifier, there has been infringement of ResMed’s patents. These products include: iVolve nasal mask, iVolve N2 nasal mask, Willow nasal pillows mask and iVolve full face mask.

The Chief Administrative Officer & Global General Counsel of ResMed Inc. (NYSE:RMD), David Pendarvis said that the decision given by the Judge was a victory of product innovation of the company, which is the focal point of brand. He added that the company shall “continue innovating and continue protecting our intellectual property” in case where they found intellectual property being infringed.

The company, which is involved in distribution, development and manufacturing of managing, diagnosing and treating sleep-related breathing, also added that the decision given by administrative law judge of ITC was a victory of not just the company, but also its patients, who deserved high quality products.
