Two Trump cases<\/a> converged in the U.S. Supreme Court on Thursday, when Justice Brett Kavanaugh asked a penetrating question.\u00a0What\u2019s to stop a “creative prosecutor” from using a “vague statute” to prosecute a president, especially, a prosecutor from the “opposing party”?<\/p>\n

In the Age of Trump, the answer is nothing.\u00a0That\u2019s precisely what Manhattan District Attorney Alvin Bragg is doing to the former president in a New York courtroom.\u00a0And Fulton County DA Fanni Willis in Georgia.\u00a0 And special counsel Jack Smith in both Washington, D.C. and Florida.\u00a0<\/p>\n

Kavanaugh\u2019s query came during oral arguments over the issue of presidential immunity asserted by Trump in the January 6th case brought by Smith.\u00a0But the capacious meaning was crystal clear.\u00a0It was echoed by another Justice, Neil Gorsuch, who worried aloud about the use (or misuse) of “criminal law to target political opponents based on accusations about their motives.”<\/p>\n

TRUMP COMPLIMENTS PROSECUTION’S FIRST WITNESS IN CRIMINAL TRIAL: ‘VERY NICE’<\/strong><\/a><\/p>\n

Of the four criminal indictments of Trump, the Bragg case is the most egregious example of this nightmare scenario.\u00a0It is exactly what it appears to be: a politically motivated case conjured up by an unscrupulous prosecutor to fulfill a campaign promise to nail President Joe Biden\u2019s rival, Donald Trump.\u00a0To accomplish it, Bragg creatively exhumed not just vague statutes, but expired ones, that do not remotely support the conduct charged.\u00a0<\/p>\n

Any neutral and objective judge who is knowledgeable in the law would have long ago dismissed Bragg\u2019s sham charges. Instead, the case went to Judge Juan Merchan whose anti-Trump bias is on conspicuous display whenever he takes the bench.\u00a0His unconstitutional gag order on the leading candidate for president is but one in a string of head-banging pronouncements.<\/p>\n

David Pecker<\/a>, the ex-publisher of the National Enquirer, was back on the witness stand on Thursday. Pecker\u2019s testimony, mind you, is immaterial and incompetent.\u00a0He knows nothing about the 34 criminal counts of falsifying business records for which Trump is on trial. No matter.\u00a0Bragg\u2019s strategy is to tie Trump to the sleazy dealings of a notorious tabloid.\u00a0If you\u2019ve heard of guilt by association, this is filth by association.\u00a0But it doesn\u2019t establish a crime.\u00a0\u00a0<\/p>\n

Like Pavlov\u2019s dog, Pecker dutifully regurgitated the desired answer to a pre-planned and loaded question from Assistant D.A. Joshua Steinglass.\u00a0When asked if he was aware that influencing an election at the request of a candidate was unlawful, Pecker replied, “yes.”\u00a0 In truth and in law, it is not.\u00a0You\u2019ll find it nowhere in the criminal codes. The prosecution simply made it up. \u00a0<\/p>\n

For more than two centuries, candidates have been promoting positive stories and concealing negative ones.\u00a0As Fox News contributor and former federal prosecutor Andrew McCarthy <\/a>pointed out, “It\u2019s not a crime for a candidate and his supporters to try to influence an election \u2014that\u2019s what a political campaign exists to do.” \u00a0<\/p>\n

What is arguably illegal, however, is to conspire by “unlawful means.”\u00a0But that\u2019s not what happened in this so-called “hush money” case involving porn star Stormy Daniels<\/a>.\u00a0She demanded cash and Trump capitulated.\u00a0She signed a non-disclosure agreement in exchange for her silence. No crime there.\u00a0Completely legal. \u00a0\u00a0<\/p>\n

Purchasing the rights to someone\u2019s salacious story with no intent to publish it is also lawful.\u00a0Why?\u00a0Because there is no victim, and there was mutual assent by two parties.\u00a0Daniels pocketed the handsome sum of $130,000 and signed a contract with the National Enquire that imposed no duty on the tabloid to actually run her story.\u00a0So, once again, there\u2019s no crime. \u00a0\u00a0<\/p>\n

TRUMP ATTORNEY, SUPREME COURT JUSTICE CLASH ON WHETHER A PRESIDENT WHO ‘ORDERED’ A ‘COUP’ COULD BE PROSECUTED<\/strong><\/a>\u00a0<\/p>\n

Nor is it illegal for a candidate or publication to suppress politically damaging information.\u00a0If it were otherwise, candidate Joe Biden would have been prosecuted for conspiring with others to bury or censor the infamous laptop story in the weeks before the 2020 presidential election.\u00a0Or Hillary Clinton would have been charged for smothering accusations of her husband\u2019s infidelity during the 2016 campaign.<\/p>\n

But when your last name is Trump<\/a>, there\u2019s a different standard.\u00a0If it doesn\u2019t exist in the law, rabid, partisan prosecutors will simply invent one.<\/p>\n

The “unlawful means” statute that Bragg is deliberately misconstruing can be found in New York Law 17-152.\u00a0You may notice that it is a misdemeanor with an expired statute of limitations.\u00a0So, as I explained in my last column, what the D.A. has done is to attach a dead business records misdemeanor to a dead campaign misdemeanor under a state law that has no application to a federal election.\u00a0<\/p>\n

Realizing this, Bragg\u2019s surrogates tried to have it both ways.\u00a0Assistant D.A. Matthew Colangelo argued during opening statements that what Trump\u00a0really<\/i>\u00a0did (wink, wink) was violate federal campaign laws.\u00a0Except, of course, he didn\u2019t. \u00a0<\/p>\n

Only the feds have jurisdiction over federal elections, not local district attorneys.\u00a0 Both the Federal Election Commission and the Justice Department<\/a> concluded that Trump\u2019s payments to Daniels did not qualify as a campaign expenditure.\u00a0Therefore, no crime was committed. \u00a0<\/p>\n

None of that has stopped Bragg from arguing the opposite by blatantly misrepresenting the law in an effort to deceive the jury.\u00a0 With a malleable judge presiding, the D.A. may just get away with it.\u00a0A Manhattan jury, eager to convict Trump for being Trump, may not realize they are being hoodwinked.\u00a0Or, they won\u2019t care. \u00a0<\/p>\n

The whole thing is cartoonish.\u00a0Like Bullwinkle J. Moose and his damned top hat.\u00a0He loved to say, “Hey Rocky!\u00a0Nothing up my sleeve!\u00a0(Tears off sleeve). Watch me pull a rabbit out of my hat!”\u00a0Then, the moment he said, “presto!”\u2026the head of a roaring lion would pop out.\u00a0Or some other silly animal. \u00a0<\/p>\n

That\u2019s Alvin Bragg.\u00a0He\u2019s Bullwinkle.\u00a0In a fair court of law with an impartial jury, his magic trick would fail miserably.\u00a0But these Manhattan jurors<\/a> may be predisposed to see a white bunny instead of the lion that actually appears.\u00a0<\/p>\n
