The federal government\u00a0has threatened\u00a0to\u00a0withhold Medicare, Medicaid and CHIP funds from\u00a0a Catholic hospital\u00a0in Oklahoma<\/a>\u00a0because the staff keeps one small candle burning in its chapel. It\u2019s\u00a0tiny, encased in glass, and kept far away from medical equipment, but the feds insist\u00a0it\u2019s\u00a0a safety risk. <\/p>\n

It\u2019s\u00a0absurd,\u00a0but not surprising. Absurdities are a feature of administrative\u00a0rule. <\/p>\n

What is\u00a0administrative\u00a0rule?\u00a0It\u2019s\u00a0a system of government where\u00a0nearly every\u00a0aspect of citizens\u2019 lives is regulated by obnoxious laws that nobody voted on enforced by pedantic bureaucrats\u00a0who nobody voted for. <\/p>\n

The\u00a0candle is just one example.\u00a0There are many.\u00a0<\/p>\n

GOP TAKES AIM AT BUREAUCRACY REGULATING AMERICAN LIFE: \u2018DEMOCRACY DIES IN A CUBICLE\u2019<\/strong><\/a><\/p>\n

Federal\u00a0water\u00a0regulators\u00a0are fighting a\u00a016-year-long battle\u00a0to\u00a0prevent\u00a0the owners of a dry plot of land from building a home, under the theory that the land contains “navigable waters”<\/a> because\u00a0it is connected by a road to a\u00a0marsh,\u00a0by marsh\u00a0to a ditch,\u00a0by ditch\u00a0to a creek,\u00a0and by creek to a river.\u00a0<\/p>\n

And state governments\u00a0have\u00a0ticketed and fined children\u00a0for running lemonade stands\u00a0without the proper food and beverage licenses. <\/p>\n

Administrative rule is America\u2019s system of government. We\u00a0were\u00a0a republic\u00a0once, but our representatives\u00a0didn\u2019t\u00a0like<\/a> the pressure of governing, so they\u00a0foisted the responsibility\u00a0onto a massive bureaucracy. <\/p>\n

How massive?\u00a0Nobody knows\u00a0exactly how many agencies there are. And nobody has a clue how many rules and regulations they administer. <\/p>\n

We know that there are hundreds of thousands of pages of laws and regulations. We know that our administrative agencies publish thousands more every year. But nobody knows how many rules they\u00a0contain. Neither the smartest lawyer, nor the most learned judge has the slightest clue what the law, in total, is. <\/p>\n

BIG BUREAUCRACY FUMBLED COVID AND OUR FAITH IN INSTITUTIONS<\/strong><\/a><\/p>\n

And\u00a0that\u2019s\u00a0just the federal law. State legislatures have followed Congress\u2019\u00a0bad example and foisted their jobs onto state agencies. <\/p>\n

This is a problem. None of us voted for or has any ability to vote against any of these laws. And nobody, short of our\u00a0buck-passing\u00a0congressmen, can fire the bureaucrats who make them. Self-government\u00a0is\u00a0more\u00a0faded memory than reality. <\/p>\n

What\u2019s\u00a0more, nobody can\u00a0possibly\u00a0comply\u00a0with\u00a0the law because nobody can know it. And where, as in America, the law regulates\u00a0nearly everything\u00a0a citizen does, a\u00a0citizen\u2019s\u00a0life is full of\u00a0invisible legal traps. Losing federal funding is the risk posed by some of these traps. But others will strip a citizen of his business, his job or his\u00a0freedom. <\/p>\n

Even the most lawful and conscientious citizen can\u00a0fall into\u00a0jail\u00a0by tripping over\u00a0some arcane regulation about\u00a0recycling bottles\u00a0or\u00a0packaging lobsters. <\/p>\n

It\u2019s\u00a0bad enough that\u00a0bureaucrats\u00a0fuss over the\u00a0little details\u00a0of our lives. But where things\u00a0go from bad to worse\u00a0is when bias creeps in. <\/p>\n

Some bureaucrats are doubtless well-intentioned, albeit in the overbearing way that nannies supervising unruly children are. But some are not. Some of them are\u00a0power-trippers. Others are discriminators. Some are both and enjoy using their power to harm people they\u00a0don\u2019t\u00a0like.<\/p>\n

In the case of the candle in the hospital chapel<\/a>, it could be that the hospital\u2019s regulator just loves rules for rules\u2019 sake. The finger-wagging type: “Well,\u00a0technically<\/i>\u00a0the law does say all\u00a0<\/i>flames must\u00a0be supervised at all times.”<\/p>\n

Or\u00a0perhaps\u00a0the\u00a0regulator hates religious organizations and people<\/a>. <\/p>\n

It would be easy\u00a0to rummage through the hundreds of thousands of laws to find one or two to throw at religious people or any other group of people a regulator dislikes. <\/p>\n

There are too many rules for people to know, so they cannot conform their behavior to them. And there are too many rules for bureaucrats to enforce equally, so bureaucrats are free to\u00a0pick and choose\u00a0their targets. <\/p>\n

This is the greatest problem of a system of administrative laws: it tends to become a system of no laws at all. It replaces the rule of laws \u2013 general, equal and knowable \u2013 with the rule of men who enforce unknowable decrees unequally and with absolute discretion. And\u00a0so\u00a010,000\u00a0little rules become\u00a010,000\u00a0little tyrannies. <\/p>\n

If there is to be any hope for self-government and for the rule of law, America must abolish administrative rule.<\/p>\n<\/div>\n
