BATON ROUGE, La. \u2013 The three adult suspects accused of rape and related charges in the case of slain LSU student<\/a> Madison Brooks have been released from the Baton Rouge jail, records show.\u00a0<\/p>\n

Kaivon Washington, the 18-year-old suspect charged with third-degree rape, posted $150,000 bond and was released from Louisiana’s East Baton Rouge<\/a> Sheriff\u2019s Office lock-up on Thursday, records show.<\/p>\n

Casen Carver, 18, and 28-year-old Everett Lee, both of whom were charged with being principles to third-degree rape, posted a combined $125,000 bond and were released on Tuesday.\u00a0<\/p>\n

Lee is Washington\u2019s uncle, records show. The second third-degree rape suspect, a 17-year-old whose identity has not been released, is not due in court until February.<\/p>\n

MADISON BROOKS CASE: BATON ROUGE JUDGE SAYS SUSPECTS \u2018CALLOUSLY\u2019 LAUGHED AT LSU STUDENT SHORTLY BEFORE DEATH<\/strong><\/a><\/p>\n

In Louisiana, third-degree rape<\/u><\/a> involves sexual intercourse that “is deemed to be without the lawful consent of a victim,” according to state law.<\/p>\n

Brooks, 19, died after she was struck by a car in\u00a0East Baton Rouge Parish in the early morning hours of Jan. 15. On Monday, investigators announced they had arrested the four males after two of them allegedly raped an intoxicated Brooks \u2013 while the other two were present \u2013 inside a vehicle before dropping her off shortly before she was struck.<\/p>\n

A spokesperson for East Baton Rouge Parish Sheriff\u2019s Office told Fox News Digital the person who struck Brooks is not facing criminal charges, and added that the person “was not impaired and contacted emergency personnel immediately.”<\/p>\n

Shane Evans, the chief of investigations for the East Baton Rouge Parish Coroner\u2019s Office, told Fox News Digital Brooks died from “multiple traumatic injuries 2nd motor vehicle collision vs. pedestrian.” The manner of death is still listed as pending.<\/p>\n

Documents related to the four arrests describe how the suspects and the victim had been drinking alcohol at a bar on Bob Pettit Boulevard, called Reggie\u2019s, located roughly\u00a0one mile from LSU campus.<\/a><\/p>\n

The four men\u00a0left the bar<\/a> with the victim, according to police records. Carver allegedly told police that Brooks “asked for a ride home.” “[H]e admitted that he agreed to give her the ride because he did not want to leave her while very intoxicated and the bar was closing.”<\/p>\n

Carver drove the vehicle, while Lee sat in the front passenger seat, Carver told police. Washington and the minor suspect sat in the back seat with Brooks, according to the\u00a0police documents<\/a>. Carver told police that both Washington and the 17-year-old asked Brooks multiple times “if she wanted to have sex,” the affidavit states.\u00a0<\/p>\n

He said she consented to Washington and the 17-year-old but added that “he thought the victim was \u2018drunker\u2019 and her speech was slurred,” according to the affidavit.<\/p>\n

He told police that he and Lee were still in the vehicle at the time of the sex acts, the affidavit states, but that “he felt uncomfortable and he \u2018hated it,\u2019” the document adds.<\/p>\n

“During the interview, the co-defendant (Carver) was asked if the victim was too impaired to consent to the sexual intercourse and he replied, \u2018I guess,\u2019” the document continues.<\/p>\n

During Tuesday\u2019s bond hearing, 19th Judicial District Judge Brad Myers said he personally had viewed footage related to the case, according to\u00a0local news station WAFB-TV<\/a>.\u00a0<\/p>\n

Specifically, Myers said he watched a video of Brooks and the suspects from inside the vehicle, according to the report. Myers said footage, which was allegedly taken by one of the four suspects, depicted the others “callously” laughing at Brooks, who appeared to slur as she spoke, according to the report. The video reportedly did not include the alleged rape.\u00a0<\/p>\n

Myers also saw footage that showed Brooks inside Reggie\u2019s earlier in the night as she struggled to stand up and could be seen falling, WAFB reported. Police records show Brooks had a blood-alcohol content of 0.319% at the time of her death.<\/p>\n

Attorneys for the suspects had previously argued that video showed the victim was not drunk to the point where she was unable to consent to sex. Attorney Ronald Haley, who is representing two of the suspects, previously said video showed Brooks “willfully got into the car,” according to FOX 8.<\/p>\n

“Absolutely not a rape,” he said prior to Tuesday\u2019s hearing. “Listen, this is a tragedy,\u00a0definitely not a crime<\/a>.”<\/p>\n

He acknowledged that Brooks appeared intoxicated, according to FOX 8.\u00a0<\/p>\n

“To the point under the law that you say you\u2019re in a drunken stupor, to the point that you cannot lawfully give consent or answer questions? Absolutely that was not the case,” he said.\u00a0<\/p>\n

But Myers disagreed and said he believed based on the footage and other evidence that a crime<\/a> had occurred, according to WAVB.\u00a0<\/p>\n

“The evidence to me is clear,” Myers reportedly said.\u00a0<\/p>\n

Also during Tuesday\u2019s court hearing, prosecutors announced they would be seeking to charge the suspects with first-degree rape, though it was not clear if they planned to take the action against all or only some of the males, the outlet reported. Prosecutors are also expected to empanel a grand jury.<\/p>\n

Visitation and funeral services<\/a>\u00a0for Brooks will be held in Covington, Louisiana, on Friday, Feb. 3.<\/p>\n<\/div>\n
