The procedural battle over Trump Mar-a-Lago documents continued Tuesday as the Justice Department <\/a>and the former president\u2019s legal team faced off in front of a three-judge panel from the 11th Circuit Court of Appeals in Atlanta.<\/p>\n

Government prosecutors on Tuesday pressed the judges from the 11th Circuit to put an end to U.S. District Court Judge Aileen Cannon\u2019s plan to have a court-appointed special master go through thousands of documents seized during the FBI\u2019s unprecedented raid of Trump\u2019s Mar-a-Lago home.<\/a><\/p>\n

Cannon appointed Raymond Dearie to serve as special master to sift through records, looking for documents possibly covered by attorney-client privilege.<\/p>\n

“[Trump] hasn\u2019t shown a need for the documents,” said government prosecutor Sopan Joshi. “Plaintiff has access to all the docs except the classified ones. \u2026 He has shown that what he wants is not the documents but to keep the government from using the documents.”<\/p>\n

TRUMP TARGETED: A LOOK AT THE INVESTIGATIONS INVOLVING THE FORMER PRESIDENT; FROM RUSSIA TO MAR-A-LAGO<\/u><\/strong><\/a><\/p>\n

Trump\u2019s defense team, though, returned to the argument that the raid on Mar-a-Lago left the\u00a0country in an unprecedented situation.<\/p>\n

“I would start with the broader premise that there is no situation in the history of our country where a sitting president authorized a raid on a former president\u2019s home,” said Trump defense attorney Jim Trusty.<\/p>\n

“Raid?” Asked one of the judges.<\/p>\n

“Sorry,” Trusty said. “The execution of a warrant.”\u00a0<\/p>\n

Trusty urged the panel to allow Cannon\u2019s appointment of a special master to play out, noting that they currently are “in a process that this judge has created.”<\/p>\n

The panel, though, seemed skeptical.<\/p>\n

“We\u2019ve got to be concerned about the precedent we would set,” a judge said. “Any target could go into a court and have them entertain this kind of petition and interfere with the executive branch\u2019s ongoing investigation.”<\/p>\n

The three-judge panel for today\u2019s hearing was randomly selected and consisted of Judge William Pryor, appointed by President George W. Bush, and Judge Britt Grant and Judge Andrew Brasher, both appointed by former President Trump.<\/p>\n

The three-judge panel did not issue a ruling from the bench.<\/p>\n

Meanwhile, Special Master Dearie has summoned government prosecutors and Trump’s defense for a status conference in Federal Court in Brooklyn Dec. 1.<\/p>\n

Trusty said that process is almost complete, with both sides down to a disagreement about 930 documents. The sides disagree about whether executive privilege would apply to those documents.\u00a0<\/p>\n

The hearing Tuesday came just days after Attorney General Merrick Garland appointed former DOJ official Jack Smith as special counsel to take over the Justice Department\u2019s criminal probe into the retention of presidential records at Trump\u2019s Mar-a-Lago home.<\/p>\n

Smith will also oversee the DOJ\u2019s investigation into the Capitol riot on Jan. 6, 2021.<\/p>\n

It is unclear which documents Smith has seen, but the Justice Department is in possession of approximately 100 of the documents that the government considered to be classified.<\/p>\n

FBI agents seized classified records from former President Trump\u2019s home at Mar-a-Lago during the\u00a0agency’s unprecedented raid Aug. 8,<\/a>\u00a0including some marked as top secret, according to a warrant and property receipt.<\/p>\n

Trump and his legal team have said the records held at Mar-a-Lago had been declassified when Trump was in the White House, but the Justice Department argues that Trump was unlawfully retaining national defense information at his home.<\/p>\n

According to the property receipt, FBI agents took approximately 20 boxes of items<\/a> from the premises, including one set of documents marked as “Various classified\/TS\/SCI documents,” which refers to top secret\/sensitive compartmented information.<\/p>\n

Records covered by that government classification level could include human intelligence and information<\/a> that, if disclosed, could jeopardize relations between the U.S. and other nations, as well as the lives of intelligence operatives abroad. However, the classification also encompasses national security information related to the daily operations of the U.S. president.\u00a0<\/p>\n

TRUMP ELEVATES MAR-A-LAGO RAID BATTLE TO SUPREME COURT<\/u><\/strong><\/a><\/p>\n

The government conducted the search in response to what it believes to be a violation of federal laws: 18 USC 793 \u2014 Gathering, transmitting or losing defense information; 18 USC 2071 \u2014 Concealment, removal or mutilation; and 18 USC 1519 \u2014 Destruction, alteration or falsification of records in Federal investigations.\u00a0<\/p>\n

The allegation of “gathering, transmitting or losing defense information” falls under the Espionage Act.\u00a0<\/p>\n

The former president and his team continue to dispute the classification and believe the information and records to have been declassified.\u00a0<\/p>\n

With the appointment of Smith as special counsel, it is unclear how long Dearie will remain special master.<\/p>\n<\/div>\n
