For me, the\u00a0Supreme Court\u00a0argument in the Harvard affirmative-action\u00a0case\u00a0was personal.\u00a0Growing up\u00a0poor in Los Angeles,\u00a0as the son of Colombian immigrants, I faced\u00a0my share of\u00a0racist\u00a0taunts\u00a0and stereotyping.\u00a0In high school,\u00a0I recall\u00a0my White\u00a0French teacher asking where I wanted to\u00a0go to\u00a0college.\u00a0I said the Naval Academy. In front of all the other students\u00a0she blurted,\u00a0“You can\u2019t go THERE!” <\/p>\n

And you know\u00a0what? She was right.\u00a0I\u00a0went to Harvard Law School instead.\u00a0<\/p>\n

But\u00a0how\u00a0exactly\u00a0did a kid with my background get\u00a0to Harvard, and what did affirmative action have to do with it?\u00a0As with many things in life, the answer is complicated.\u00a0<\/p>\n

Between high school and law school, I\u00a0went to\u00a0the University of Southern California and encountered a\u00a0veritable\u00a0cornucopia of affirmative action programs for Black and Hispanic students.\u00a0I became\u00a0an INROADS intern\u00a0and\u00a0scored\u00a0four\u00a0straight summer internships doing prestigious work at\u00a0Bank of America.\u00a0As\u00a0a McNair Scholar,\u00a0I\u00a0got\u00a0privileged\u00a0access to\u00a0free summer\u00a0housing,\u00a0professors\u00a0and research\u00a0resources\u00a0to boost my chances of\u00a0becoming\u00a0an academic.\u00a0<\/p>\n

These opportunities and more were\u00a0all\u00a0laid out for me on a silver platter \u2014 but\u00a0I was\u00a0always uneasy about it. <\/p>\n

All this time\u00a0I had a\u00a0Chinese American\u00a0girlfriend\u00a0who,\u00a0despite being\u00a0exceedingly bright and\u00a0coming\u00a0from the same city I did,\u00a0was\u00a0flatly barred from these\u00a0opportunities\u00a0because she was the wrong skin color. I knew she could run circles around\u00a0my\u00a0classmates\u00a0in terms of academic performance, presentation skills\u00a0and\u00a0professionalism,\u00a0but\u00a0alas,\u00a0she was\u00a0Asian American, and that\u00a0fact\u00a0alone disqualified her.\u00a0The cognitive dissonance was too much, so\u00a0I pledged not to participate in any more race-segregated programs. <\/p>\n

My next step was grad school at Carnegie Mellon University where I flourished. But not everyone did. I tutored a struggling classmate who clearly lacked the skills and preparation for CMU\u2019s graduate level work. I was furious at the administration for setting her up for failure, so I questioned the admissions director about the school’s admission practices. He told me that his primary mission was boosting the number of Blacks and Hispanics and proudly showed me a special list he kept for tracking his numerical progress. Then it dawned on me. I had been on that list, and so had my struggling classmate, because she was African-American.<\/p>\n

While\u00a0interning\u00a0in\u00a0D.C.,\u00a0I attended\u00a0an\u00a0event featuring Ward\u00a0Connerly \u2014 the driving force in ending affirmative action in California’s public universities. During the Q&A, I volunteered that I\u00a0was applying\u00a0to law school, including the Ivy League,\u00a0and asked\u00a0Connerly\u00a0point blank,\u00a0“should I check the box?”\u00a0He paused and\u00a0said that\u00a0he wouldn\u2019t blame given\u00a0the\u00a0huge benefits offered,\u00a0but ultimately said\u00a0“it\u2019s up to you.”\u00a0Yes, it was.\u00a0<\/p>\n

I had\u00a0a\u00a0killer\u00a0GPA, but\u00a0it wasn\u2019t from an Ivy\u00a0League school\u00a0and about 50% of Harvard Law students came from\u00a0the\u00a0Ivies\u00a0at the time.\u00a0I thought I had a great LSAT score, but great\u00a0in this context\u00a0was “only” average for Harvard.\u00a0In short, I\u00a0had a strong application,\u00a0but\u00a0my\u00a0admission wasn\u2019t a given.\u00a0It would all depend on how I compared to\u00a0all\u00a0the\u00a0other applicants. Or perhaps not.\u00a0<\/p>\n

Hispanics going to top law schools\u00a0at the time\u00a0had LSAT scores 6.87 points\u00a0lower on average<\/a>\u00a0than Whites,\u00a0with Black students\u00a0trailing a full\u00a09.30 points behind. This meant that\u00a0vanishingly small numbers\u00a0of\u00a0Blacks\u00a0and\u00a0Hispanics were\u00a0scoring\u00a0in the\u00a0first percentile, which is the Harvard\u00a0sweet spot.\u00a0Before\u00a0applying\u00a0I\u00a0pored over\u00a0publicly available\u00a0LSAT statistics and\u00a0realized that\u00a0I placed among the highest scoring fraction of a percent of Hispanics in the country.<\/p>\n

By checking the box,\u00a0my place\u00a0at Harvard would be\u00a0assured.\u00a0So, I said a prayer, filled out the forms, and left the box empty.\u00a0<\/p>\n

My\u00a0heritage\u00a0and my\u00a0life choices\u00a0mattered then as they do now. But\u00a0I\u00a0refused to\u00a0let my worth\u00a0and my story\u00a0be\u00a0reduced to a box. I refused\u00a0to\u00a0risk taking\u00a0a\u00a0spot from a\u00a0more-qualified student\u00a0because they\u00a0happened to be Asian\u00a0American or White.\u00a0But most of all,\u00a0I didn\u2019t check the box\u00a0because I wanted to\u00a0be able to say,\u00a0without hesitation,\u00a0that I got\u00a0into\u00a0Harvard Law School because\u00a0of\u00a0my father\u2019s hard work, my\u00a0mother\u2019s fervent prayers, and my own exertions. No\u00a0stigma, no guilt, no self-doubt\u00a0and\u00a0no guarantee of failure or success. <\/p>\n

That\u2019s the\u00a0freedom\u00a0that comes from not checking the box.\u00a0That\u2019s what equal opportunity\u00a0truly\u00a0means.\u00a0I hope\u00a0the Supreme Court\u00a0agrees.\u00a0<\/p>\n<\/div>\n
