Apple Inc. (NASDAQ:AAPL) has lost a lawsuit against the sale of Samsung older smartphones in the US, denting it a major setback in its global patent battle. A court ruling by a US district judge Lucy Koh, concluded that Apple had not provided sufficient evidence to show that its patented features had been violated by the Samsung Older smartphones which are not on sale as of the moment.<\/p>\n
Apple and Samsung have been entangled in a battle royal on claims that Samsung used some of Apple\u2019s patented features such as the use of fingers to pinch and screen zoom. Apple also claims it owns the patent for phone\u2019s flat black glass screen, which Samsung has used in some of its devices.<\/p>\n
Apple had already been awarded a total of $900 million for similar claims but has failed on a number of times to impose a ban on the sale of its rival\u2019s products in the US. Samsung on their part were impressed by the ruling as they maintain, fewer features in their devices don\u2019t drive the huge sales they usually command.<\/p>\n
Apple wanted the injunction to be imposed even though Samsung is not selling its older model phones, arguing that such an injunction would help prevent Samsung from using some of its features in the future. Samsung on their part maintain Apple is only trying to instilfear on its carriers and retailers.<\/p>\n
Apple accused of tax evasion in Australia<\/b><\/p>\n
Apple in other news is finding itself on hot water with Australian authorities after being accused of shifting more than $8.9 billion in profits to avoid paying taxes in the country. According to an investigation carried by the Australian Financial Review, Apple has been directing the amount to Ireland for the past 10 years.<\/p>\n
There has been a major crackdown in Australia especially on multinational companies which embezzle funds to avoid paying taxes. Some of the tax payers in Australia maintain that Apple should face the full force of the law, so as to provide a level playing ground with other companies in the industry.<\/p>\n
The investigation was carried out on Apple\u2019s Australian branch financial accounts of the past 10 years although Apple has not confirmed if the data used was accurate. Apple falls into the basket of other multinational companies such as Google Inc.
